This Agreement is a binding legal document between you (“Participant”) and any individual organizer, host, volunteer, owner or controller of the playing facility, and the mobile application, website, platform or service used to organize or facilitate the pickup game (collectively, “Organizers and Platform”), in connection with your participation in a pickup sporting event (for example, basketball, soccer, or similar recreational athletic activity) arranged through a digital invitation or online listing. By electing to join, registering, clicking “Join,”, “I’m In”, or otherwise accepting or requesting an invitation to participate in a pickup game via the mobile application or website, you acknowledge and agree that your assent to the terms of this Agreement is effective immediately and has the same force and effect as a signed written agreement. No physical signature is required for the Agreement to be valid and enforceable.
Acknowledgment of Risk. I understand and acknowledge that participation in pickup sporting activities involves inherent risks and hazards, including but not limited to: slips, trips and falls; collisions with other participants, equipment, or fixed objects; strains, sprains, fractures, head, neck, spinal or other serious injuries; exposure to environmental conditions; and unpredictable acts of third parties. I recognize that such risks may result in bodily injury, permanent disability, death, or property damage.
Assumption of Risk. To the fullest extent permitted by law, I freely and voluntarily assume all risks associated with my participation, whether known or unknown, inherent or otherwise, including those arising from the negligence of others or the condition of the playing area, and regardless of whether the Organizers and Platform have provided warnings or safety equipment.
Release and Waiver. In consideration of being permitted to participate, I, on behalf of myself, my heirs, executors, administrators, legal representatives and assigns, hereby waive, release, and forever discharge the Organizers and Platform and their officers, directors, employees, agents, volunteers, contractors, successors and assigns from any and all claims, demands, causes of action, suits, liabilities, losses, damages, expenses (including reasonable attorneys’ fees), judgments and costs of any kind or nature whatsoever, whether arising from negligence, strict liability, or any other legal theory, that I may have now or in the future related to my participation in the pickup game, to the maximum extent allowed by applicable law.
Indemnification. I agree to indemnify, defend and hold harmless the Organizers and Platform from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or related to my negligent acts or omissions, intentional misconduct, breach of this Agreement, or violation of applicable rules or regulations while participating in the activity.
Medical Treatment and Insurance. I understand that the Organizers and Platform do not provide medical insurance or guarantee medical care. In the event of injury or illness, I authorize the Organizers and Platform to provide or arrange medical treatment and agree to be responsible for all costs of such treatment. I confirm that I have adequate medical insurance or financial resources to cover any medical expenses I may incur as a result of participation.
Fitness to Participate. I represent and warrant that I am in good physical condition, have no medical or physical conditions that would preclude my safe participation, and that I will not participate while under the influence of alcohol, illegal drugs, or any prescription medication that impairs my ability to participate safely.
Minor Participants. If I am signing on behalf of a minor (under the age of majority in the relevant jurisdiction), I affirm that I am the minor’s parent or legal guardian and have full authority to enter into this Agreement on the minor’s behalf. I agree to assume all risks and accept all terms of this Agreement for the minor and to indemnify the Organizers and Platform for any claims brought by or on behalf of the minor.
Photography and Media. I grant permission for the Organizers and Platform to use photographs, video, or other media that include my image or likeness for informational, promotional or archival purposes, without compensation, unless prohibited by law. If you do not consent to media use, you must notify the organizer in writing prior to participation.
Rules and Conduct. I agree to comply with any rules, directions, safety instructions, or decisions of organizers or facility staff. I understand that organizers may eject participants for unsafe, abusive, or unlawful conduct without refund.
Governing Law and Severability. This Agreement shall be governed by the laws of the jurisdiction where the pickup game is held, to the extent permitted by law. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Acknowledgment of Understanding. I have read this Agreement carefully, understand its terms, and acknowledge that by joining the pickup game I am knowingly and voluntarily giving up substantial legal rights, including the right to sue the Organizers and Platform for negligence or other claims to the fullest extent permitted by law. If any portion of this Agreement conflicts with mandatory local laws, those laws shall govern to the extent required. This Agreement constitutes the entire understanding between the parties regarding the subject matter herein.
